Waiver

Participant Agreement, Release, and Assumption of Risk

In consideration of the services provided by VIRAMAYA LLC, including its agents, owners, officers, managers, volunteers, employees, and all other persons or entities acting on their behalf, I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate, hereby agree to the following terms:

Acknowledgment of Risks: I understand and acknowledge that participating in roller skating activities involves inherent risks, both known and unknown, which could result in physical or emotional injury, paralysis, death, or damage to myself, others, or property. These risks include, but are not limited to: slipping and falling; collisions with fixed objects or people; exposure to insects; falls from significant heights; pinches, twists, and jolts; strains, sprains, broken bones, and other musculoskeletal injuries; cuts, abrasions, and bruises; cardiac-related illnesses; heat exhaustion, sunburn, heatstroke, and dehydration; transmission of pathogens or diseases; negligence of participants or other persons present; equipment failure or operator error; and my own physical condition and exertion associated with the activity.
Furthermore, I understand that while VIRAMAYA LLC personnel strive to ensure safety, they may not be infallible and may be unaware of a participant's fitness or abilities, misjudge weather or environmental conditions, provide incomplete warnings or instructions, or experience equipment malfunctions.

Assumption of Risks: I expressly agree to accept and assume all risks associated with participating in roller skating activities. My participation is voluntary, and I choose to engage in the activity despite these risks.

Release and Indemnification: I voluntarily release, forever discharge, and agree to indemnify and hold harmless VIRAMAYA LLC from all claims, demands, or causes of action arising from my participation in the activity or use of VIRAMAYA LLC equipment or facilities, including claims alleging negligent acts or omissions of VIRAMAYA LLC.

Legal Expenses: I agree to indemnify VIRAMAYA LLC for any attorney's fees and costs incurred in enforcing this agreement.

Insurance and Medical Expenses: I certify that I have adequate insurance coverage for any injury or damage I may cause or suffer while participating. Alternatively, I agree to bear the costs of such injury or damage myself. I also certify my willingness to assume the risk of any medical or physical condition I may have.

Jurisdiction and Severability: Any legal action against VIRAMAYA LLC shall be filed solely in the state of New York, and the substantive law of that state shall apply, irrespective of conflict of law rules. If any part of this agreement is deemed void or unenforceable, the remaining provisions shall remain in full force and effect.

By signing this document, I acknowledge that I may waive my right to sue VIRAMAYA LLC for any injuries or damages sustained during participation in the activity. I also agree that this agreement is valid for subsequent visits and participation at VIRAMAYA LLC. I confirm that I have read, understood, and agreed to be bound by its terms.
